📍 Policy Summary:

The Safe Venue & Guest Accountability Act (SVGAA) will require licensed venues in New York State to implement minimum public safety protocols that protect guests from unfair ejection, defamation, and unsafe travel outcomes. This bill ensures that no person attending a public or private event is left to defend themselves from false accusations or forced to navigate unsafe conditions due to venue negligence or one-sided claims.

  • No uniform state regulation requiring neutral incident reporting or evidence retention.
  • Guests can be ejected based solely on hearsay without recourse.
  • Property may be confiscated or withheld without due process.
  • Falsely accused guests often lack safe transportation or support.
  • Venues rarely accept accountability for negligence or false claims.

These gaps disproportionately impact working-class individuals and political outsiders.

✅ The Solution:

Under SVGAA, all venues hosting 25+ person gatherings must:

  • Document incidents in a standardized report signed by staff and involved parties.
  • Secure guest property with a time-stamped chain of custody.
  • Provide safe travel options (ride service or escort) for any ejected guest.
  • Install and retain security footage for 30 days with subpoena protection.
  • Prohibit public accusations by staff unless legally substantiated.

🛠️ Implementation:

  • Administered by: NYS Department of Consumer Protection & Licensing
  • Enforced during liquor license renewals and event permit processing
  • Penalties:
    • Minimum $10,000 fines
    • Public citations listed on NYS business portals
    • Civil liability for harm caused by negligence or false removal
